1. Employment Entity & Labor Contract Compliance

Foreign companies are not permitted to directly hire Chinese employees via overseas entities. To recruit staff legally in mainland China, foreign enterprises must sign employment contracts through a locally registered legal entity, such as a wholly foreign-owned enterprise, subsidiary or branch company established in China.
A written labor contract is mandatory and must be signed within 30 days of an employee’s onboarding. Any failure to complete written contract signing will result in the employer paying double wages to the employee as compensation. All labor agreements are governed by Chinese labor laws, and verbal contracts or overseas parent company employment contracts are not recognized and are deemed non-compliant in China.

2. Mandatory Social Insurance Contribution

Full social insurance coverage is legally compulsory for all Chinese employees hired by foreign firms, including pension insurance, medical insurance, unemployment insurance, work injury insurance and maternity insurance.
Any private agreement between employers and employees to waive, reduce or avoid social insurance payments is null and void by law. Regulatory inspections have been greatly strengthened in 2026. Non-compliant enterprises will face mandatory back-payment of social insurance arrears, daily late fees and administrative fines. Foreign-invested companies are strictly required to contribute social insurance based on official salary base standards in local cities.

3. Rules for Hiring Foreign Nationals in China

Strict updated policies for foreign employees have been fully implemented in 2026. All foreign staff engaged in paid work in China must obtain a valid Foreigner Work Permit, Z-visa and work-type residence permit. It is illegal for foreigners to work in China with tourist or business visas.
Foreign talents are classified into Category A (high-end talents), Category B (professional talents) and Category C (general workers) with strict salary threshold requirements. Legally employed foreign employees are fully protected by China’s labor laws, enjoying the same labor contract rules, dismissal compensation regulations and social insurance obligations as local Chinese employees.
