Nationwide Malaysia Crackdown Kicks Off This July! Heavy Penalties Await Overstayers & Undocumented Foreign Workers

Starting July, Malaysia will launch a nationwide special compliance sweep targeting foreign nationals, covering key areas including Kuala Lumpur, Selangor, Johor Bahru, Malacca and Pahang with unprecedented enforcement intensity.

All foreign individuals working or running businesses in Malaysia, together with foreign-invested enterprises, must conduct advance internal compliance audits to evade legal liabilities.

This joint operation is carried out by five authorities: Immigration Department, Royal Police, Road Transport Department, Ministry of Domestic Trade and Consumer Affairs, and Kuala Lumpur City Hall. The campaign targets no specific nationalities, aiming to standardise market order, boost local employment and curb tax losses.

Multi-agency inspections will focus on three major violations across the whole country:

  1. Overstaying and undertaking paid work while holding tourist visas
  2. Conducting commercial operations without valid business licences
  3. Illegal hiring and non-compliant employment of foreign workers by companies

Corporate Consequences: Unlicensed Business & Illegal Foreign Workers = License Revocation + Dual Liability

This nationwide crackdown targets two grey-area business models: local nominees fronting business ownership and hiring undocumented foreign workers. Any enterprise found committing these violations will have its business licence revoked immediately and be ordered to cease all operations.
Notably, penalties apply to more than just the actual operating entity. Local nominees who hold shares or lend their identity for business registration will also bear corresponding legal liabilities. Authorities enforce dual accountability with zero tolerance. Do not cross legal boundaries for temporary convenience.
This full-country sweep marks the definitive end of the grey-area era for foreigners starting businesses or working in Malaysia, bringing fundamental shifts to industry regulations. Those operating in Malaysia going forward must recognise two core trends:
  1. Low-cost speculative business models will be eliminated entirely.

Historically common cost-cutting loopholes including unlicensed operations, tax evasion and illegal labour hiring are being fully eradicated. With regularised compliance supervision and standardised law enforcement, market entry and operational compliance costs will rise steadily, phasing out speculative operators.

  2. Compliant operations become the foundation for long-term sustainability.

Enterprises with valid registration, full tax payment and lawful employment will benefit from a fairer, more transparent competitive landscape. For foreign firms and expatriate workers, shifting from profit-seeking loopholes to fully compliant management and boosting internal compliance capabilities will be the key competitive advantage for long-term market presence in Malaysia.

Final Reminder: Compliance is the bottom line and prerequisite for sustainable growth. This sweep runs for an extended period with full national coverage and rigorous enforcement — do not take chances. Conduct internal compliance audits promptly to mitigate risks, navigate the regulatory campaign smoothly and achieve stable long-term development.
