Must-Read for Enterprises Expanding into Singapore: Don’t Skip This Critical Step During Employee Offboarding!

When processing employee termination in Singapore, apart from settling final salaries, unused annual leave, bonuses, payment in lieu of notice and severance benefits, employers may face an easily overlooked tax procedure: IR21 Tax Clearance.

Simply put, IR21 is a tax clearance notification submitted by employers to the Inland Revenue Authority of Singapore (IRAS). Based on the declared employee income, withheld monies and personal particulars, IRAS determines whether income tax must be deducted from outstanding payments due to the employee. Upon receiving the Clearance Directive, the employer remits tax as instructed and releases the remaining balance, or releases the full withheld amount if no tax is payable.

This process hinges not merely on the fact of resignation, but on whether the employee is a non‑Singapore Citizen, whether they will depart Singapore or take up an overseas posting, whether statutory exemptions apply, and whether the employer has withheld relevant payments in a timely manner.

This article outlines applicable scenarios, filing timelines and operational best practices for IR21 tax clearance. It helps overseas enterprises standardise offboarding workflows, mitigate tax compliance risks and avoid delayed salary settlement caused by late filings. For ease of reference, Gonex provides a glossary of essential English terms for Singapore operations. HR teams supporting Singapore staffing may message【Singapore】to obtain the resource!

I. Which departing employees require IR21 Tax Clearance?

Generally, employers need to assess IR21 obligations for the following groups or scenarios:

  • Non‑Singapore Citizens whose employment in Singapore ends, including resignation, dismissal, contract expiry, retirement or other termination events.
  • Non‑Singapore Citizens who are about to commence an overseas posting or overseas assignment.
  • Non‑Singapore Citizens planning to leave Singapore for more than 3 months.
  • Holders of work passes, including Employment Pass, S Pass, Work Permit, ONE Pass, Personalised Employment Pass and other work visas.
  • Singapore Permanent Residents (SPR) may also require tax clearance if they intend to leave Singapore permanently upon termination, or are assigned overseas and do not qualify for IRAS exemptions.

IR21 is therefore not only triggered when a foreign employee departs immediately after resignation. For non‑Singapore Citizens, IR21 assessment should form part of offboarding whenever termination, an absence from Singapore exceeding 3 months or an overseas posting occurs.

II. Is IR21 mandatory for every non‑Citizen termination?

Not all non‑Singapore Citizen terminations require an IR21 submission. IRAS grants exemptions or administrative concessions for certain cases. Common exemptions include:

  • Singapore Citizens leaving employment: no IR21 required.
  • SPR resigning with no intention to depart Singapore permanently: the employer may obtain and retain a Letter of Undertaking from the employee, and IR21 is generally not needed.
  • Non‑Singapore Citizens working 60 days or less within a calendar year: usually exempt; this exemption does not apply to company directors, public entertainers and specified professionals.
  • Eligible continuous employment with low income, for example meeting IRAS working‑day criteria and annual income below S$21,000, may also be exempt.
  • Employees transferred to another Singapore entity within the same group due to merger, acquisition or restructuring: employers may notify IRAS via myTax Mail and submit exemption templates following IRAS guidance.
  • Employees leaving Singapore for 3–6 months for training or business trips, or qualifying short‑term overseas postings where the employee will return to serve the same employer, the work pass remains sponsored by the same employer and the Singapore employer continues remuneration.

Assessment cannot rely solely on nationality or termination status. Key considerations include the employee’s pass and residential status, permanent departure intention, actual days worked in Singapore, annual income, prior employment with other Singapore employers in the same or preceding year, and taxable items such as bonuses, payment in lieu, severance, equity gains and benefits‑in‑kind.

III. Key Timelines for IR21 Tax Clearance

Timeline Key Matters for Employers
When you know the employee will resign or depart From the date you become aware that the employee will cease employment, depart Singapore or commence an overseas posting, withhold all payments due to the employee, including salaries, overtime pay, leave pay, allowances, reimbursements, bonuses, discretionary payments, one-off payments, etc.
At least 1 month prior to resignation, posting or departure If tax clearance is required, you shall submit Form IR21 at least 1 month in advance. If the employee resigns abruptly or advance notice of 1 month is not practically feasible, submit it as soon as possible and state the reason in IR21.
Upon submission of IR21 Declare the employee’s income earned in the year of resignation or departure. If the income from the preceding year has not yet been transmitted to IRAS via AIS at the time of tax clearance, it must also be declared together. Where termination compensation, notice pay, emoluments, equity or benefits are involved, break down the details as required by IRAS.
During IRAS processing The standard processing time is 7 working days for e-Filing and 21 calendar days for paper filing. The timeline may be extended if documents are incomplete or further clarifications are requested by IRAS.
Upon receipt of the Clearance Directive You will receive either a Directive to Pay Tax or a Notification to Release Monies. The former means tax must be remitted to IRAS per the directive; the latter authorises you to release the withheld monies.
Within 10 days after the date of Directive to Pay Tax If you receive a Directive to Pay Tax, settle the payment within 10 days from the directive date, then release the remaining withheld monies to the employee. If additional income arises subsequently, submit an Additional or Amended Form IR21 and continue withholding relevant monies until a new clearance directive is issued.

The most frequent compliance failure arises from misalignment between payroll disbursement and IRAS processing schedules. Enterprises should manage activities according to the official timeline.

IV. How can employers obtain the Clearance Directive?

Once IRAS completes review, a Clearance Directive will be issued to the employer. Two delivery channels are common in practice:

  • Hardcopy: mailed by IRAS, typically received within 5–7 working days after clearance completion.
  • Electronic copy: available on the myTax Portal within 3 working days after Form IR21 is processed. Employers log in with Corppass authorisation and access notices and letters under the Tax Clearance service for employers.

For status checks, users may select “View Form IR21 Records” on myTax Portal to track filing and clearance progress. E‑filing offers instant submission confirmation, online status tracking and printable Clearance Directives, removing reliance on postal delivery.

After receiving the directive, HR, Payroll and Finance should centrally retain records including directive type, issue date, tax payable, payment deadline, Payment Slip Number, actual tax remittance date, balance released to the employee and release date. These records support payroll evidence, audits and stakeholder communications.

V. Anonymous Case Study: IR21 Directive for a Foreign Employee upon Termination

A foreign employee of a Singapore‑based company was scheduled to resign on 31 July 2026. The employee was neither a Singapore Citizen nor an exempt SPR, so the company followed the IR21 clearance procedure.

Prior to the last working day, the company compiled payroll records covering January to July 2026 and declared year‑to‑date income on Form IR21. It also reported monies withheld from the employee as the source for tax settlement and future balance release.

IRAS subsequently issued a Directive to Pay Tax, requiring the company to remit personal income tax from the withheld funds by the stipulated date and release the residual amount to the employee after payment. The directive also noted that any additional remuneration, bonuses or outstanding payments arising after the original filing would require a supplementary or amended Form IR21, with continued withholding pending a new clearance directive.

This case illustrates that IR21 is more than a one‑time form submission. It directly governs payment sequencing: which sums can be released with regular final payroll, which must be withheld, the tax amount assessed by IRAS and when the balance may be disbursed. Extra lead time is especially critical for cross‑border assignees, high‑earning foreign staff, employees with substantial year‑to‑date income and packages including termination benefits.

VI. Practical Recommendations for Enterprises

Integrate IR21 assessment into your standard offboarding checklist, rather than reviewing it only before final payroll runs:

  1. Confirm whether the employee is a Singapore Citizen, SPR or non‑Citizen, and document their work pass status.
  2. For SPRs, confirm plans for permanent departure and obtain a Letter of Undertaking where applicable.
  3. Record the last working day, intended departure date and overseas posting commencement date.
  4. Calculate and withhold all outstanding entitlements: final salary, unused leave, bonuses, payment in lieu, severance, honoraria, reimbursements, benefits and equity proceeds.
  5. E‑File Form IR21 via myTax Portal wherever possible to accelerate processing and enable online status monitoring.
  6. Remit tax and release balances strictly per the Clearance Directive, retaining full payment and release records.
  7. Do not release funds immediately if additional income or adjustments emerge after the original IR21 filing. Submit an Additional or Amended Form IR21 and await a revised directive.

In short: Singapore IR21 Tax Clearance is a statutory tax filing and withholding arrangement for non‑Singapore Citizens upon termination, departure or overseas posting. Early assessment enables smooth final salary and severance settlement. Delayed handling commonly leads to payment delays, under‑withholding, penalties and remedial filings.
